the property comprised in the indenture dated 1st june 1838 is to be held in trust and to the intent that: the said building now used as a chapel may for ever hereafter be used as a roman catholic chapel for divine worship by persons professing the roman catholic religion according to the faith and rites of the roman catholic church and according and subject to the regulations from time to time in force and practised amongst roman catholics in the place district or division where the said chapel is situate so nevertheless that the same be not contrary to the laws of england and further that the roman catholic priest for the time being duly appointed as herein after mentioned shall and may celebrate divine service in the said chapel at his and their will and pleasure according to the laws rites and practices of the roman catholic church may demise or let the pews seats and benches of the said chapel and occupy and enjoy the said messuages cottages gardens lands and premises or receive and take rents issues and profits thereof to and for his own use and benefit for or towards his maintenance and support he keeping the same in good repair and that the trust for the time being shall and may use any part of the said lands as a burial ground or cemetery for interring the bodies of deceased roman catholics and may receive and take therefore reasonable rewards fees and remuneration as well for the celebration of funeral rites as for the land or groundso that the same be not aliened or disposed of otherwise than for the purpose of interring the dead and so that no privilege of interment be granted in anticipation of expectancy subject to the payment to the priest for the time being of the usual and accustomed reward or fee on each interment.and that the sum of six hundred and sixty six pounds thirteen shillings and four pence per centum consolidated bank annuities in or upon which the same shall be invested and the interest dividends and annual produce in trust to pay the interest dividends or annual produce unto or to permit the same to be received by the officiating priest for the time being of the said chapel and congregation.
